Check whether you are eligible to make a personal injury claim — including time limits, the types of accidents we cover, and what evidence you will need.

Eligibility for a Personal Injury Claim

To make a personal injury claim you generally need to satisfy three basic criteria: the accident must have been caused by someone else's negligence, you must have suffered an injury as a result, and the accident must have occurred within the last three years.

Unlike Legal Aid, making a No Win No Fee claim for personal injury is available to almost anyone — regardless of your income or employment status. As long as you have a valid claim, you can access specialist legal help.

Time Limits

In most personal injury cases, you have three years from the date of the accident to start legal proceedings. Missing this deadline will almost certainly mean your claim cannot be pursued, so it is important to act quickly.

There are some exceptions to the three-year rule. If the injured person is a child, the three-year clock does not start until their 18th birthday. Similarly, if the injury only became apparent some time after the accident — as is common in industrial disease or medical negligence cases — the time limit runs from when you first knew (or ought reasonably to have known) about the injury.

Types of Accidents We Handle

We can assist with a wide range of personal injury claims including: road traffic accidents (including whiplash), accidents at work, slips and trips in public places, medical negligence, product liability, holiday accidents abroad, and sports injuries.

If you are unsure whether your situation qualifies, simply complete our free assessment form or call us on 0800 180 4001. One of our advisers will give you an honest, no-obligation assessment of your prospects.

What Evidence Do You Need?

The stronger your evidence, the stronger your claim. Useful evidence includes: photographs of the accident scene and your injuries, a record of medical treatment received, witness contact details, an incident report (if the accident happened at work or in a public place), and any correspondence with the responsible party.

Do not worry if you do not have all of this — our solicitors are experienced at gathering evidence and can advise you on the best steps to take.
